Background
A strategic partnership between the International Scholars Program and PivotPlus Solutions to empower global talent.
In recent years, the demand for highly skilled professionals to contribute to the United States' economy and innovation landscape has grown rapidly. Among the most sought-after immigration pathways is the EB2 NIW visa, which allows individuals with advanced degrees or exceptional abilities to live and work in the U.S. without employer sponsorship, provided they can demonstrate that their contributions serve the national interest.
Recognizing the complexity and potential of this opportunity, International Scholars Program (ISP), a leading organization in global academic and professional mobility, has entered into a strategic partnership with PivotPlus Solutions, a tech-driven immigration and visa consultancy firm providing global mobility solutions and post-settlement support services.

Introduction
Every year, the US government allocates approximately 40,000 Employment-Based Second Preference (EB2) National Interest Waiver (NIW) visas to individuals from diverse nationalities worldwide.
The EB2 NIW visa category allows foreign nationals to secure permanent residence in the US without needing an employer sponsor. Anyone meeting the qualifications can apply, regardless of whether they are in the US or abroad.
Unfortunately, despite many qualifying individuals, only a small segment is aware of this visa or the process for a successful application. The complexities of navigating the requirements often deter potential applicants from pursuing the EB2 NIW pathway.

Message from Our Directors
Program Overview
The US government views the EB2 NIW visa as a strategic way to attract global talent with extraordinary ability, advanced degrees, or expertise in fields of national importance.
The EB2 NIW is a sub-category of the broader EB2 Visa (Employment-Based, Second Preference) classification. Unlike the standard EB2 pathway that requires employer sponsorship and labor certification, the National Interest Waiver (NIW) allows these requirements to be waived in the interest of the United States.
| Feature | Description |
|---|---|
| Category | Employment-Based, Second Preference (EB-2) |
| Waiver | National Interest Waiver (bypasses labor certification and employer sponsorship) |
| Path to Green Card | Yes - Permanent Residence |
| Family Inclusion | Spouse and children (under 21) can receive green cards too |
| Self-petition | Allowed (We guide you to file a strong petition) |
Eligibility Criteria
To qualify for the EB2 NIW visa, applicants must meet both the EB2 requirements and the NIW specific criteria, demonstrating substantial merit in their field and expertise significantly above ordinary levels.
Advanced Degree Requirements
Common Misconception: Many assume only PhD holders and professors qualify. This is absolutely not the case!
- Bachelor's + 5 Years: Bachelor's degree in relevant field with progressive five years of post-degree experience
- Master's or Graduate Degree: The five years of experience requirement is waived
- Experience-Based: Applicants without formal education may qualify with at least ten years of experience and recognition/awards in their field (e.g., athletics)
Exceptional Ability (3 of 7 Criteria)
The USCIS uses a 7-criteria rule to evaluate exceptional ability. You must satisfy at least 3 of the following:
- Academic Records: Degree, diploma, certificate from institution relating to your area of exceptional ability
- Experience Letters: Documentation of full-time experience in your occupation
- Professional License: License to practice your profession or occupation certification
- Salary Evidence: Evidence of commanding salary/remuneration demonstrating exceptional ability
- Professional Membership: Membership in professional association(s)
- Recognition: Recognition for achievements by peers, government entities, or professional organizations
- Comparable Evidence: Other acceptable evidence of eligibility
National Interest Waiver (NIW) Requirements
You must demonstrate that granting permanent employment serves the country's national interest through:
- Innovative work tied to national importance
- Professional exceptional ability in limited fields/regions
- Unique job proposals that benefit the U.S.
- Self-employment that doesn't negatively impact U.S. labor market
